Terms and Conditions of Sale.

Article 1 – Definitions
For the purposes of these terms and conditions, the following definitions apply:

Cooling-off period: the period during which the consumer may exercise their right of withdrawal.
Consumer: the natural person who is not acting in the course of a profession or business and who enters into a distance contract with the entrepreneur.
Day: calendar day.
Fixed-term transaction: a distance contract relating to a series of products and/or services for which the delivery and/or purchase obligation is spread over time.
Durable medium: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.
Right of withdrawal: the consumer’s right to cancel the distance contract during the cooling-off period.
Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.
Distance contract: a contract concluded as part of an organized system operated by the entrepreneur for the distance sale of products and/or services, using exclusively one or more means of distance communication up to and including the conclusion of the contract.
Means of distance communication: a method that can be used to conclude a contract without the consumer and entrepreneur being physically present in the same place at the same time.
General Terms and Conditions: these general terms and conditions of the entrepreneur.

Article 2 – Right of Withdrawal
The consumer has the right to cancel the contract without giving any reason within 30 days. During this period, the consumer must handle the product and its packaging with care.

If the consumer exercises the right of withdrawal, the product must be returned with all supplied accessories and, where reasonably possible, in its original condition and packaging, in accordance with the entrepreneur’s reasonable instructions.

Article 3 – Applicability
These General Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract concluded between the entrepreneur and the consumer.

Before the contract is concluded, the text of these General Terms and Conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed where the terms can be viewed and that they will be sent free of charge upon request.

If the contract is concluded electronically, the terms may be provided electronically in such a way that the consumer can easily store them on a durable medium.

If additional specific terms apply, the consumer may always rely on the provision that is most favorable to them.

If any provision is found to be invalid, the remainder of the contract will remain in effect and the invalid provision will be replaced by an equivalent provision.

Situations not covered by these terms must be interpreted in accordance with the spirit of these General Terms and Conditions.

Article 4 – The Offer
If an offer is subject to a limited validity period or specific conditions, this will be clearly stated.

The offer is non-binding and may be amended.

It contains a complete and accurate description of the products and/or services.

Images are representative but not contractually binding.

Obvious errors do not bind the entrepreneur.

Images and specifications are indicative.

Colors may differ from their appearance in real life.

Each offer includes, among other things:

  • Any applicable shipping costs
  • The procedure for concluding the contract
  • Whether or not a right of withdrawal applies
  • Payment and delivery methods
  • The validity period of the offer
  • Costs associated with distance communication
  • How the contract is archived
  • The possibility of reviewing and correcting entered information
  • Available languages
  • Applicable codes of conduct
  • The minimum duration in the case of a fixed-term transaction
  • Optional: sizes, colors, and materials

Article 5 – The Contract
The contract is concluded when the consumer accepts the offer.

The entrepreneur will immediately confirm receipt.

The consumer may cancel as long as the confirmation has not yet been sent.

The entrepreneur ensures the security of personal data and payments.

The entrepreneur may refuse an order for justified reasons.

The following information will be provided:

  • The address for submitting complaints
  • The conditions governing the right of withdrawal
  • Guarantees and after-sales service
  • Information relating to the offer
  • Conditions for termination

Article 6 – Right of Withdrawal for Products
The consumer may cancel the purchase within 30 days.

The cooling-off period begins after the product has been received.

The product must be handled with care.

The return must be complete and, where reasonably possible, in its original packaging.

The consumer must notify the entrepreneur of their decision within 30 days.

The product must be returned within 30 days after providing this notification.

If these requirements are not met, the sale becomes final.

Article 7 – Costs in the Event of Withdrawal
Return shipping costs are the responsibility of the consumer.

The refund will be issued within 30 days after the returned product has been received.

Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal may be excluded for:

  • Personalized products
  • Personal-use products
  • Perishable products
  • Products linked to financial market fluctuations
  • Newspapers and magazines
  • Unsealed software
  • Unsealed hygiene products

Article 9 – Prices
Prices will not change during the validity period of the offer, except where changes are related to VAT.

Variable prices are permitted where they depend on market fluctuations.

Price increases are limited in accordance with applicable law.

Typographical errors are not binding.

Article 10 – Conformity and Warranty
Products must comply with the contract and applicable law.

Any warranty does not affect the consumer’s statutory rights.

Defects must be reported within 30 days.

The warranty may be voided in cases of misuse.

Article 11 – Delivery and Performance
Orders will be processed and fulfilled with due care.

Delivery will take place within 30 days unless otherwise agreed.

In the event of a delay, the consumer may have the right to cancel the order.

Refunds will be issued within 30 days.

Replacement products may be offered.

The risk passes to the consumer upon delivery.

Article 12 – Duration, Termination and Renewal
The consumer may terminate the agreement at any time, subject to a maximum notice period of one month.

Automatic renewals are limited.

After one year, the consumer may terminate the agreement at any time.

Article 13 – Payment
Payment must be made within 7 days unless otherwise agreed.

The consumer must report any payment errors.

In the event of non-payment, additional fees may be charged.

Article 14 – Complaints
Complaints must be submitted within 7 days.

A response will be provided within 14 days.

Legal proceedings may be initiated if necessary.

The parties’ obligations are not suspended while a complaint is being handled.

Article 15 – Disputes
Dutch law applies, even if the consumer resides abroad.
